According to Texas Civil Practice and Remedies Code § 16.003 (a), the statute of limitations for car accident claims in Texas is two years from the date of the crash. However, if the responsible party or defendant is a public entity or a government employee, then the statute of limitations is six months from the date of the accident. For claims for property damage — such as damage to the vehicle — the statute of limitations is (again) two years from the date of the accident. According to Texas Civil Practice and Remedies Code § 16.003 (b), a Texas wrongful death claim must also be filed within the same two-year deadline from the date of the death of the injured person.  Important exceptions apply, especially when children are involved, so it’s important to get legal advise right away.
